When deciding whether to become a Host on Airbnb in Italy, it is important for you to understand the laws in your region or city. As a platform and online marketplace we do not provide legal advice, but we want to provide resources that may help you better understand applicable laws and regulations. This list is not exhaustive, but it may give you a good start in understanding your local laws.

There are three  requirements for the Tuscany region that are applicable, whether you are a professional Host or an individual, to tourist rentals with contracts not exceeding 30 days—Structural requirements, Notification of accommodation to be used as a tourist rental, and Reporting tourist data. Structural requirements

Before starting, you must make sure that your property has:

  • The structural and health and hygiene requirements laid down for houses for private use
  • The safety and health conditions of buildings and installed systems required by current legislation

Notification of accommodation to be used as a tourist rental

You must notify the municipality regarding the accommodation to be used as a tourist rental. To do this, access Open Toscana.

For the tourist rental—whether it involves entire properties or portions of them, of any duration—you must notify the territorially competent municipality of:

  • The activity that you will carry out
  • The form of business activity, if applicable
  • The period during which you intend to rent the accommodation
  • The website used to publish the accommodation

You must fill out the notification for each property you intend to rent out and for which you will receive an identification code.

Please note that this notification is mandatory and, if you fail, you may incur an administrative fine.

Reporting tourist data

In order to meet statistical requirements, you must report the tourist flows to the territorially competent municipality. For more information, please consult the form of the municipality where your property is located. Please remember to report flows monthly, even if there were no guests.

Difference between tourist rentals and other extra-hotel facilities

Please note that tourist rental is different from extra-hotel facilities (ex: holiday homes and apartments or guest houses, etc.) for which regional legislation provides several other obligations (ex: the obligation to display prices).

Bear in mind that, in case of tourist rental, you can’t offer typical services of the extra-hotel facilities like daily laundry change; daily cleaning etc. Otherwise, you may incur an administrative fine.
